1.2 You are solely responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account. Cypherus is not liable for any loss or damage arising from unauthorized access to your account.
2.1 Cypherus will make every reasonable effort to provide maximum uptime. However, services are provided on an "as is" and "as available" basis.
2.2 We reserve the right to perform scheduled and emergency maintenance. We will attempt to notify you in advance of scheduled maintenance that may cause service interruptions.
2.3 While we may perform internal backups for disaster recovery, we do not guarantee data backups for customers. You are strictly responsible for maintaining independent backups of all your data stored on our servers.
3.1 To ensure the stability and security of our network, you agree NOT to use Cypherus services for any of the following activities:
3.2 Violation of this AUP may result in immediate suspension or termination of your services without a refund.
4.1 Services are billed on a prepaid basis. Invoices are generated before the renewal date.
4.2 Failure to pay an invoice by the due date will result in the suspension of services. Services that remain unpaid for 5 days after the due date may be permanently terminated and all associated data deleted.
4.3 We offer a 7-day money-back guarantee for new customers on eligible services. Dedicated servers, domain names, and custom setups are strictly non-refundable. Any violation of our AUP voids your eligibility for a refund.
4.4 Initiating a payment chargeback or dispute via PayPal, Stripe, or your bank without contacting our support team first will result in immediate termination of all active services and the permanent closure of your Cypherus account.
5.1 You may cancel your services at any time via the billing portal. Cancellation requests must be submitted before the next billing cycle to avoid being charged.
5.2 We reserve the right to suspend or terminate your service at any time, with or without notice, if we determine that you have violated these Terms, failed to pay your invoices, or if your usage poses a risk to our infrastructure.
To the maximum extent permitted by law, Cypherus, its employees, and its partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages. This includes, but is not limited to, loss of profits, loss of data, business interruption, or financial losses arising out of your use or inability to use our services, even if we have been advised of the possibility of such damages.
You agree to indemnify, defend, and hold harmless Cypherus from any claims, damages, liabilities, costs, or expenses (including legal fees) arising from your use of the services, your violation of these Terms, or your infringement of any third-party rights.
Cypherus reserves the right to update or modify these Terms at any time. We will notify customers of any significant changes via email or an announcement on our website. Continued use of our services after such changes constitutes your acceptance of the new Terms.
These Terms shall be governed by and construed in accordance with the laws of the BENELUX region & Germany. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located near our business operation's registration.
